Terms of use of the learning platform
Version of October 1, 2026
Draft: this text is still under legal review and is not binding. Missing details are marked.
This is a translation to help you understand. Only the German version is legally binding.
1. What this is about
These terms govern the use of the learning platform lms.lernsfera.com of Lernsfera Academy, Inhaberin: Irina Quent, Am Dichtlacker 9, 94529 Aicha vorm Wald, Deutschland (“we”).
They concern the platform only. The language course itself is governed by the course contract that you or your company concluded with us.
2. Registration and account
You can create an account only with an invitation link. Please give truthful details and keep them up to date. Each person has their own account. You must be at least 16 years old.
Use of the platform is free of charge for learners.
3. Access data
Keep your password secret and do not pass your account on to others. If you suspect that someone is using your account, change your password and tell us at once. We recommend two-factor sign-in; it is mandatory for staff.
4. Lessons and recordings
You use the platform for your own learning. In particular it is not allowed to:
- give other people access to your account or to course content,
- read out content automatically or circumvent protective measures,
- post unlawful, insulting or discriminatory content,
- make or pass on image or sound recordings of other participants or teachers without their consent.
5. Content and copyright
Learning materials, texts, tasks and recordings are protected by copyright. For the duration of your course you receive the simple, non-transferable right to use them for your own learning.
Content you upload yourself, such as homework, remains yours. You allow us to store it and show it to your teachers as far as the course requires.
6. Availability
We aim for trouble-free operation. Because of maintenance, further development or reasons beyond our control the platform may be unavailable at times. We may change features as far as this is reasonable for you.
7. Blocking
In the event of a serious breach of these terms we may block your account temporarily or permanently. We will inform you and give you the opportunity to comment as far as possible.
8. Duration and termination
You can delete your account at any time in the settings. We may end the use with four weeks’ notice. The right of both sides to terminate for good cause remains unaffected.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and as far as we have given a guarantee.
For slight negligence we are liable only if we have breached an essential contractual duty, that is, a duty whose fulfilment makes use of the platform possible in the first place and on which you may rely. In that case liability is limited to the foreseeable damage typical for the contract. Otherwise liability is excluded.
10. Changes to these terms
We may change these terms if there is an objective reason, such as new features or a change in the law. We announce changes at least four weeks in advance in the platform or by e-mail and ask for your agreement at your next sign-in. If you do not agree, we may end the use when the change takes effect.
11. Final provisions
German law applies. If you are a consumer, the mandatory protective provisions of the state in which you have your habitual residence remain unaffected.
If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Deggendorf.
The contract language is German. Translations are for understanding only; the German version is authoritative.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
Should a provision be invalid, the remaining provisions stay in force.
